OFCCP Affirmative Action Program Portal Now Live

Key Details: The Office of Federal Contract Compliance Program (OFCCP) announced on December 2, 2021, the new Affirmative Action Program Verification Interface (Portal). This Portal was created to ensure oversight over federal contractor Affirmative Action Programs. OFCCP Affirmative Action Program Portal Dates, Deadlines, & Details

The Portal went live on February 1, 2022, with OFCCP issuing a bulletin on the same day encouraging contractors to register to the Portal by March 30, 2022, to avoid delays with certification. Registered contractors will be able to begin their certification process through the Portal beginning March 31, 2022. The deadline for completion is June 30, 2022.

It is important to note that new contractors must also develop and certify their Affirmative Action Program(s) (AAP) and have 120 days to do so. Following development of their AAPs, new contractors must register and certify compliance with the Portal within 90 days. Contractors should also note that only supply and service contractors are required to use the Portal to certify their AAP compliance. This applies to businesses performing on a contract of $50,000 or more and employing over 50 people. The OFCCP has released this Jurisdiction Threshold Infographic to guide contractors.

Contractors and subcontractors are encouraged to register and certify their AAPs by the dates highlighted above to remain compliant. Noncompliance may invite audits, create liability claims, and inhibit a contractor’s ability to bid on future contracts.

The OFCCP has provided a user guide and updated frequently asked questions to help contractors during this process. The user guide is a step-by-step resource that walks contractors through the registration and verification process. The OFCCP has also provided a sample AAP to guide contractors in the development of their programs and policies.

Contractors that plan to register to the Portal are encouraged to do so before the March 30 deadline to avoid delays and to become familiar with the population of data and administration of personnel access.
